Terms of Service

1. Acceptance of Terms

By accessing or using the Mighty Process Server platform (“the Platform”), operated by Mighty Process Server LLC (“we,” “us,” or “the Company”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Platform. Your continued use of the Platform constitutes acceptance of any updates or modifications to these Terms.

2. Description of Service

Mighty Process Server is a software-as-a-service (SaaS) platform that connects legal professionals with process servers nationwide. The Platform provides tools for job management, dispatching, bidding, accounting, client relationship management, document handling, AI-powered document extraction, affidavit generation, and community networking. The Platform does not provide legal advice and is not a law firm. MightyAutomationAI, the Platform's AI assistant, provides educational information only and should not be relied upon as legal counsel.

3. User Accounts

You must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms or that contain false or misleading information.

4. Subscriptions & Billing

The Platform offers multiple subscription tiers (Individual, Premium, and Enterprise) with varying features and pricing. Subscription fees are billed monthly on the 1st of each month. New subscribers receive complimentary access from their signup date until the 1st of the following month.

Platform transaction fees apply only to jobs received through the Mighty Process Server directory and are charged daily, settled at the end of each billing cycle. Self-created jobs are not subject to platform fees. You authorize us to charge your designated payment method for all applicable fees. Failure to pay may result in suspension or termination of your account.

5. Permitted Use

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You may not:

• Use the Platform for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to any part of the Platform
• Interfere with or disrupt the Platform or its servers
• Scrape, data-mine, or harvest data from the Platform without written consent
• Impersonate another user or provide false information
• Use the Platform to send unsolicited communications or spam
• Reverse engineer, decompile, or disassemble any part of the Platform
• Use automated systems (bots, crawlers) to access the Platform without authorization

6. User Content & Data

You retain ownership of any content you submit to the Platform, including but not limited to legal documents, affidavits, client information, and community posts. By uploading content, you grant us a limited, non-exclusive license to store, process, and display that content as necessary to provide the Platform's services. We will not share your content with third parties except as described in our Privacy Policy or as required by law.

Documents processed by MightyAutomationAI (our AI document extraction system) are analyzed solely to extract case information for your use. We do not use your legal documents to train general AI models or share them with other users.

7. Directory Listings

Process servers listed in our directory are independent contractors and are not employees, agents, or representatives of Mighty Process Server LLC. We do not guarantee the quality, reliability, or timeliness of any process server's work. Our MPS Verified program provides an additional layer of background verification but does not constitute a guarantee of performance. Users are responsible for their own due diligence when selecting and engaging process servers through the Platform.

8. Intellectual Property

All content, features, and functionality of the Platform — including but not limited to text, graphics, logos, icons, software, MightyAutomationAI technology, and the compilation thereof — are the exclusive property of Mighty Process Server LLC and are protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

9. Embeddable Widget

Eligible subscribers may embed the MightyAutomationAI chat widget on their own websites using the embed codes provided in the Platform. The widget must display the “Powered by MightyAutomationAI” attribution and may not be modified to remove branding. Widget usage is subject to these Terms and our acceptable use policies. We reserve the right to revoke widget access for any violation.

10. Privacy & Data Protection

Your use of the Platform is also governed by our Privacy Policy. By using the Platform, you consent to the collection, use, and sharing of your information as described in our Privacy Policy. We take reasonable measures to protect your personal data but cannot guarantee absolute security. We comply with applicable data protection laws including applicable provisions of the CCPA, and we process data in accordance with our stated purposes.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Mighty Process Server LLC, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Platform. Our total liability for any claim arising from these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Mighty Process Server LLC and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds will be issued for partial months. Upon termination, we will retain your data for 30 days to allow for account recovery, after which it may be permanently deleted.

14. Disclaimers

The Platform is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the accuracy, reliability, or completeness of any content on the Platform. We do not verify the credentials, background, or qualifications of process servers listed on the Platform beyond our voluntary MPS Verified program. AI-generated content and document extraction results should be reviewed for accuracy before reliance.

15. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Platform shall be resolved exclusively in the state or federal courts located in Orange County, Florida. You agree to submit to the personal jurisdiction of such courts.

16. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through a notice on the Platform. Your continued use of the Platform after such changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
